Terms of Use

1. Agreement

These terms are an agreement between you and Ozan Kılıç (“we”, “us”), the developer of Hush Trail (the “Game”). By downloading or using the Game or the website hushtrail.app you agree to them. If you don’t agree, please don’t use the Game. If you are under the age of majority where you live, a parent or guardian should review these terms with you.

2. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to download and play the Game on devices you own or control, for your own non-commercial entertainment, in line with the usage rules of the App Store or Google Play.

You may not: copy, sell, rent, sublicense or redistribute the Game; modify, decompile or reverse-engineer it except where the law expressly allows; remove copyright notices; or use the Game to build a competing product.

3. Ownership

The Game, including its code, world, vehicles, art, music, sound and the Hush Trail name and logo, belongs to us or our licensors and is protected by intellectual-property law. Some components are used under open licences — for example, nature models by Quaternius (CC0), ambient recordings from BigSoundBank (CC0) and the Nunito typeface (SIL Open Font License) — and are credited in the Game.

4. Your photos

Screenshots and photos you take in the Game are yours to keep and share for non-commercial purposes, for example on social media. Please don’t present them as official Hush Trail material or use them to advertise other products.

5. Purchases

If the Game offers paid content, purchases are processed by Apple or Google under their terms, including their refund policies. Purchased content is licensed to you, not sold, and is tied to the store account you used.

6. It’s a game

Hush Trail is a relaxing, stylised simulation. It does not teach real off-road driving. Real vehicles, terrain and water are far less forgiving. Please don’t play while driving or walking near traffic, take breaks, and respect real trails, private land and nature.

7. Updates and availability

We may update the Game to fix bugs, improve performance or add content, and may change or remove features. We hope to keep the Game available for a long time, but we can’t promise it will always be available on every device or store.

8. No warranty

To the fullest extent permitted by law, the Game is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We don’t guarantee the Game will be error-free or uninterrupted. Nothing in these terms limits any rights you have as a consumer that cannot be limited by law.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for loss of data or profits, arising from your use of the Game. Our total liability for any claim relating to the Game is limited to the amount you paid for it, if any, in the twelve months before the claim. This does not exclude liability that cannot be excluded by law, such as liability for death or personal injury caused by negligence, or for fraud.

10. App Store and Google Play

These terms are between you and us only, not Apple or Google. Apple and Google are not responsible for the Game or its content, have no obligation to provide maintenance or support, and are not responsible for any claims relating to the Game. If the Game fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; Apple has no other warranty obligation to the extent permitted by law. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.

11. Ending the licence

You can stop using the Game at any time by deleting it. If you seriously breach these terms, your licence ends automatically. Sections 3, 8, 9 and 12 continue to apply.

12. Governing law

These terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in your local courts.

13. Changes

We may update these terms from time to time. We will change the date above and, for material changes, let you know in the Game. Continuing to use the Game after changes take effect means you accept them.
